all. i'm jon kelley. >> and i'm laura garcia-cannon. the bay area is on storm watch this morning. rain is on the way and we understand lots of it. we start out with meteorologist christina loren. she's got a timeline of it for us. >> indeed i do. good morning to you at home. you can see the leading edge of the front starting to push into the northernmost portion of the state but the winds ahead of that front are really starting to gust. look at some of these readings. west-southwest winds at 18 miles per hour in fairfield, you're 20 in novato and these winds will continue to pick up throughout the morning so give yourself plenty of time to reach your destination safely and watch out for debris on the highways. showers work out like this. stop the clock on your futurecast at noon. starting to get the first showers south of the golden gate bridge. that trend will continue as we head through the second half of your day and we're not just talking about rain for today. showers continue for tomorrow and then the cold blast moves in and we are expecting our first frost of the season. i'll tell you exactly when.

just keep that in mind when it comes to your sensitive plants and keep those pets indoors over the course of the weekend. right now i'll sending it back to you with the top stories of the day. weather is the big story. all along the east coast a monster storm creating more headaches for people there and more delays for people in the bay area. marla tellez is live in the newsroom and she is here to tell us how this is affecting thousands here and there all over again. >> reporter: good morning. first it was sandy, now it's the nor'easter that's pounding the eastern seaboard with rain, wind and snow. she's knocking out power yet again to hundreds of thousands of people who just had it restored in new york and new jersey. in trenton, new jersey, powerful waves are causing new fears of flooding for communities that are already washed out. several communities in long island now covered in white. people there cannot even get gas

as shipments there have been delayed. and from connecticut to rhode island, 3 to 6 inches of snow have fallen in the past 24 hours alone. that is still less than the 8 inches that have fallen in some parts of massachusetts. people up and down the east coast proving they are resilient. >> kind of laughing about it at this point. it's unneefbelievable to go fro hurricane to a nor'easter in the same ten days. >> reporter: parts of southern new england are expected to receive 3 to 5 inches of snow today, 8 inches in higher elevations. as for flights, no surprise, dozens more are canceled at the major airports. we're talking jfk, philadelphia and newark. here in the bay area we have checked with sfo and 11 arriving flights from east coast airports are cancelled. at this point a single departing flight from sfo bound for jfk is also cancelled. reporting from the newsroom, marla tellez, "today in the bay." happening now, poison ous gs

forced the evacuation of a popular hotel. bob redell is live in burlingame this morning with the very latest. good morning, bob. >> reporter: actually good morning to you, laura. about 400 to 500 guests according to the fire department have been evacuated from this embassy suites near sfo for the past several hours. the fire department has been ventilating this hotel to get the levels of c.o. down. the sampling equipment has come back with readings that show the levels are safe if not nonexistent which is why in the past half hour the guests have been able to go back to the rooms. the fire department was called out around midnight last night. possibly because of a c.o. alarm that was going off. when they arrived, they also had hazmat come out, the public health department. they sampled the air and found dangerous levels of carbon monoxide, a colorless, odorless

gas, very deadly gas. they found out the source was a malfunctioning boiler. they shut that off. since they still had the levels of c.o., they had to jolt a lot of these guests out of bed. >> it was probably 1:00, 1:15 or so the fire alarms went off in the hotel. at first i thought maybe somebody tripped the alarm or whatever. probably 15 minutes later the police department came on the loudspeakers and said we had to evacuate the building. >> asleep and just woke up. they did a great job inside. evacuated everything and we've been waiting and so we're leaving now. >> reporter: back out here live, you're looking at the fourth story of the embassy suites hotel where you can see the fire department is trying to get people back into the rooms. they had to open all the doors, open some windows. the hotel also had a ventilation system that was being used to push out the c.o.

the fire department doesn't know of anyone getting sick from this. at 6:30 they were out for a medical call. it's not clear if that was related, if perhaps that person had symptoms of co poisoning and that is what led them to test the air. again, a loft theought of these are going back to their rooms. reporting live here in burlingame, bob redell, "today in the bay." a map convicted of shooting his girlfriend and a man at the richmond bridge toll plaza will learn his fate today. this has been a bizarre scene in the courtroom. a jury found nathan burress guilty of two counts of first-degree murder. he acted as his own attorney and repeatedly harassed prosecutors and witnesses as they spoke during the trial. today a judge will determine whether burress should be

sentenced to death or life f prison without parole. a 19-year-old oakland man has died after driving an atv into a tree in oregon. he was a standout baseball player who graduated from antioch high school. he was attending community college in oregon. police are investigating the crash but they believe alcohol was involved. fighting fires in contra costa county is about to get more difficult. a parcel tax that would have raised millions of dollars to keep fire stations open failed in the election even though a majority of voters backed it. christey sie smith is live withe on what the election results mean to the county. >> reporter: good morning to you, jon. this is the second go-round, the second time this year that voters here in contra costa county have said no to a parcel tax request from a fire agency. but as you said, this time a majority of voters actually supported measure q. unfortunately it just wasn't enough because it needed a

two-third voter approval to pass. 52.5% of voters said yes, 47.5 said no. now, this may be died to negative feelings with firefighters' pensions, the high threshold of approval and high number of tax measures that were on this ballot. measure q was a temporary fire safety parcel tax in the contra costa fire district and would have generated about $17 million a year. the fire district says without it they may have to close 10 of 28 stations over the next couple of years. it's not clear yet which ones. but it would have cost homeowners about $75 a year. the fire chief warning that response times will probably drop because of this. in east county voters turned down a similar parcel tax in june n january, the first four stations will close, but we're told that no firefighters will be losing their jobs. reporting live in pleasant hill, christie smith, "today in the

bay." san francisco election officials say nearly 100,000 ballots have yet to be tallied an it could be days before we know the winner of the city's district 7 supervisor race. election officials say they hope to have all that counting done by saturday. votes are still being tallied in other parts of the bay area. 70,000 ballots remain to be counted in san mateo county. in east palo alto, a tie race for three city council seats still hasn't been decided. mail-in and provisional ballots are still being counted. election officials are hoping to get an update tomorrow. we have some perfect weather for everyone getting out voting on tuesday. starting to cool off and heading to the weekend. christina loren says looks like more rain. >> more rain and very gusty winds. good morning to you, jon and laura. good morning to you at home. we're about six hours away from our first showers in the north bay. at 2:00 p.m. we'll get some of those showers in the san jose area. the closer you are to the front, the gustier the winds.

you can see down south we have virtually no wind to talk about. in san mateo, calm winds. west-northwest wind at 3 miles per hour in san jose whereas we're gusting in fairfield at ape miles per hour. as we head throughout the day today, the winds are only going to get stronger as that front moves in. not a great day for the flowing skirt by any means and grab that umbrella on your way out the door. you can see starting to end up on the high end of that key with sustained wind speeds of 30 miles an hour right at the coast. we're bringing in the showers after noon. 58 in livermore, 60 in santa teresa. about 60 in los gatos and 59 in oakland and san francisco. seven-day outlook tells the story. start they thinking about the weekend on thursday. we'll get to the forecast coming up. seven-day ready to go. before you go out the door here's mike. >> we've got to give you a warning if you're heading to the

b.a.r.t. station. there's a major delay at south san francisco in the pittsburg-bay point, sfo and millbrae direction. either direction north or south you do have a problem because of the an equipment issue. b.a.r.t. determines a major delay to be anything 15 minutes or longer. we're waiting on mor specifics. mean wheel out on the roadways, the wind is affecting the conditions of your drive. the camera shakes. i'm looking for a stall or the effects thereof. the map shows you where that's marked as you're getting off of the incline into the san francisco side across the bay from the oakland side. you should see a little bit of slowing but nothing major on our maps. getting into san francisco, a smooth drive. we had earlier winds but it looks like it may have cleared from the system. but gusty conditions do continue in spots. back to you. it's 5:10. coming up, we have a warning for you. thieves have figured out a new and easy way to steal your

welcome back. it is 5:13. the man who caused so much trouble in the middle east with that anti-islamic youtube movie is now in jail this morning. but not for what he did on youtube. >> that's right. it was for a probation violation. one year in jail. it's the same guy who created the trailer, the movie "the innocence of muslims" a strange low-budget movie which caused quite a bit of disruption and even death across the middle east. his conviction involves credit card fraud and had nothing to do about the film. one of the actresses in the film filed new paperwork in her

attempt to get youtube to remove that video. she's been unsuccessful in previous attempts. meanwhile, speaker of the house john boehner has relaxed his opposition to new tax hikes to solve the budget crisis. it was a sign after the election that republicans are ready to start negotiations. it's a good sign as fears of the cliff sent the markets into their worst fall so far this year on wednesday. let's turn to jackie deangeles who's live at cnbc headquarters. good morning, jackie. >> reporter: good morning to you, scott. well, the good side and the bright side of the news is that the u.s. stock futures are trending higher at the moment. as you said after a very sharp sell-off yesterday following president obama's re-election. the overseas markets saw a mixed bag. shares in asia tumbled overnight over fears of the looming u.s. fiscal cliff while the european markets are holding on to small gains.

the dow had its worst day in a year closing below 13,000 for the first time since august 3rd to 12, 932. the s&p 500 down 33 points to 1394 and the nasdaq falling 74 points to 2937. marketwatchers no doubt looking for some signs of relief today as the s&p and the nasdaq also under key levels right now. scott. >> all right, thank you much. laura, coming up in just a bit we'll tell you how to get some nice hot tea and lemon at starbucks without taking your wallet out of your pocket. >> taking your wallet out of your pocket. >> i think i owe you several starbucks, now that i think about it. >> thank you. >> she'll let you know, scott. 5:15. let's bring in meteorologist christina loren. a little bit wet heading into the weekend on friday eve? >> a little bit wet. quite a stark contrast from where we started out the week. temperatures hit record levels. we almost broke all-time records

in november in places like gilroy where just a couple days ago we had the low 90s. today we're talking about the upper 50s. the rain is moving in. we've got a pretty potent front but watch out as you head off to work. the rain will hold off until about noon. west-southwest wind at 18 miles an hour is nothing to mess with. 20 miles an hour in novato and strong winds picking up in oakland as well. these winds will continue as we head throughout the morning hours. we'll start to see them really pick up in the south bay as the front gets closer and closer to us. hold on to the steering wheel and watch out for debris. none today is when it starts to get very active around here. our first showers coming down from novato to san francisco. stop the clock for you at 3:00 p.m. starting to get wet in san jose, fremont, livermore. even concord and oakland. as we head through tomorrow the bulk of the moisture comes through. after that the cold blast settles in and that's when we concerned about the potential

for frost. yeah, we're already talking about frost. hard to believe when we just had those record highs. so it all works out like this. grab that jacket, you'll need it all day long. 58 is it in livermore, 58 in fremont and 59 in san francisco. holding on to the upper 50s all the way through saturday, then skies clear saturday night, sunday morning our first frost of the season expected. mostly in the interior valleys of the north and the east bay. 65 by monday. calm conditions next week but it's going to take a while for that cold air to mix out. we'll be at 69 degrees by wednesday of next week. >> good morning. hey, folks, we're looking at the south bay and an easy drive right now. we just have some construction southbound side of 880. we just see a little slowing and that may be the crew starting to leave. northbound commute routes are looking pretty nice continuing up the peninsula out through

mountain view with no problem for 101. westbound, that's your commute direction for 580. no problems through livermore or pleasanton. coming out of the altamont pass you do have a little slowing. if you're heading east tonight or tomorrow, christina is warning about the weather changes. if you're heading to the sierra, you might bring those chains just in case so we'll watch that and track her updates as well. live look outside and show you how things are shaping up through oakland where there's an easy drive northbound through downtown, but notice the camera is shaking. gusty conditions continue at times through the east bay hills, across the bay bridge and maybe through the peninsula side. 101 is a nice drive. still have delays for the b.a.r.t. system out of the south san jose system. i don't know if you know knew this, mike, but one key opens up most pumps at gas stations. vicky nguyen explains more.

>> reporter: it is just a simple key, very easy to make a copy. they're a remnant from years ago when all gas station pumps were made with the same lock to make it easier for inspections and maintenance. but now police say the keys are getting into the hands of thieves and you and i are paying the price. we all do it. swipe, pay, pump. but hidden behind here, a new bluetooth enabled skimmer that can rip off your credit or debit information in seconds. the bluetooth technology makes it harder to catch crooks because once they install the devices, they can nab your numbers from your card as far away as 100 yards and never have to return to recover the skimmer. this universal gas pump key is making it easier for thieves to install them. lieutenant mike sterner leads a team looking into dozens of bluetooth skimming cases in just

the past two months, they have recovered nine skimmers and recorded 300 victims of credit card fraud in the bay area. >> the single key would open the credit card access door to any gas pump. >> reporter: that's right. one key opens the majority of gas station pumps, like this one in san jose, this one in mountain view and this one in sunnyvale. it's simple, thieves copy the keys. >> police tell us they have uncovered four skimmers at this gas station. you could change the locks to protect your customers' information. >> reporter: police say they advised this gas station owner to change his locks after they found four skimmers at his santa clara station. we met up with him after he didn't return our calls. >> ed kr, can i give you my car? >> reporter: he told us he has ordered new locks but doesn't know when they will arrive. if gas station owners change

welcome back, everybody. a live bouncy look. live look over sfo. there are some flight delays possibly going on with all that bad weather in the northeast so check with your airlines if you're flying out today. 5:23 right now. california voters ushering in a new era in state politics, not

seen in more than 100 years. democrats announcing they have won a supermajority of both houses of california's legislature. a two-thirds majority in the senate and in the assembly allows democrats to now pass tax laws, budgets and other spending issues without needing republican support. this marks the first time since 1883, that's right, back in 1883, the first time that democrats have held a supermajority here in california. >> and you know, jon, now that voters have officially passed prop 30, college students will see the benefits almost immediately. csu students will get a refund for the tuition increase they paid this semester and tuition costs will roll back even more in the spring. csu officials are working out the details, but students can expect to get about $250 of their fall tuition back. not bad. students at uc berkeley calling for some tuition cuts of their own. students will rally today to demand that prop 30 funds be used to reduce tuition and bring

back programs and classes that were originally cut due to funding. the rally coincides with the one-year anniversary of the occupy cal movement. students will gather at 2:00 today for that event. 5:25 right now. heading into the weekend, you may want to dust off your umbrellas. christina loren says get ready, the drops are coming. >> we were wearing tank tops and shorts earlier this week. now you're pulling out that heavy winter coat with highs only in the 50s. front still about five and a half, six hours away from the north bay. we'll start to see those showers spread south the second half of the day but the winds have certainly arrived and it's gusty out there so give yourself plenty of time to reach your destination safely. watch out for gusty conditions in oakland. west-northwest winds sustained at 18 miles per hour and we're expecting them to pick up throughout the day. 5:25. give us 30 seconds of your time for mike. >> give b.a.r.t. another 15

for the most part because we've got a blanket of low clouds hovering over the bay area. we're not talking about any thick patches of fog this morning. let's time it out for you and help you make those plans. you'll be pulling out your umbrella about noon from san francisco to oakland. still nice and cool and mostly cloudy in san jose. we'll start to get our first showers between 2:00 and 4:00, which means slick conditions for your evening ride home. tomorrow morning the cold blast settles in and if we see any showers over mt. hamilton, when we meet back here tomorrow morning, we could see our first snow high atop mt. hamilton. your futurecast actually does predict just that. friday we get more rain, clearing you out for the first part of saturday. then our concern is the potential for frost as we wake up on it looks like sunday morning, the best chance for that. keep that in mind because we haven't been talking about that for many months and just had a heat wave.

a lot of people not expecting frosty conditions. we'll check on your drive with mike coming up. right now i'll sending it back to you and the rest of the top stories of the day. new this morning, san jose police have reopened several streets near the matrix casino after finding a pipe bomb inside a car. this is amateur video from the scene where police were making a routine traffic stop around 11:00 last night when they noticed a suspicious package inside a car. the bomb squad came in, determined it was a live bomb and detonated it. police arrested one man. although the bomb was close to the matrix casino, no evacuations were ordered and no one was hurt. it is a chilly start this morning for hundreds of guests at a peninsula hotel near sfo and a pretty rude wake-up call. everybody being evacuated following a carbon monoxide leak at that hotel. bob redell is live outside burlingame's embassy suites hotel with all the new details. bob, good morning. >> reporter: good morning to you, jon. yes, the embassy suites hotel in

burlingame by sfo, the emergency is now over. the guests are back inside, presumably trying to get back to sleep or perhaps getting ready for work since it's already the start of the day. it didn't take long for the fire department, hazmat and public health department to figure out the source of the carbon monoxide that was spewing throughout the hotel. they were able to trace to it a malfunctioning boiler early this morning. they turned off the boiler but they had to wait for the poisonous gas to dissipate. carbon monoxide, of course, is a gas that is deadly. it's a gas you can't see and you can't smell. it's not clear if they were alerted to it by a co alarm or if there was some other incident. now, the carbon monoxide that was inside this embassy suites hotel has dissipated to the point it's obviously safe. they had their air samplers in there and detected levels that were safl or nonexistent. the 400 to 500 guests that were evacuated were forced to stay in this cool weather outside.

they have been allowed to go back inside the rooms after this unscheduled, early morning wakeup call. >> i'm staying in one of these handicapped rooms where they talk to you. get out of bed, like speak and spell. very, very startling. so i got up, thinking it was a prank and looked around for some hoodlums to stir up and maybe give some grief. then i looked outside and saw there was first responders with flashlights shining at us, like get out of the building kind of thing. that's when i decided to evacuate. >> reporter: during the co release here in this hotel, the fire department tells us there were no guests who had any issues, who were taken to the hospital. they do point out that at 6:30 last night they were called out to this hotel for a medical call. it's not clear if that's related to the co release or not. reporting live here in burlingame, bob redell, "today in the bay." the man in jail acue of gunning down a well-known east

community activist could be set free soon. a judge dismissed a murder charge against gregory elarms. the judge says police violated his fifth amendment right by ignoring his repeated request for an attorney. investigators say he eventually confessed to that crime. lewis' mother says she doesn't know why he killed her son. she said the two were childhood friends. >> i would like to see justice done. i would like to see him spend his time in prison. >> elarms is still in jail this morning on an unrelated charge. the d.a. will decide whether to refile murder charges or appeal the judge's decision. a man accused of killing a retired hercules schoolteacher inside of her home is expected to enter his plea this morning. darnell washington and his wife,

tania, are charged with the murder of susie ko. investigators say the couple stole ko's car, then fled to washington state. darnell was extradited to contra costa county last month to face charges. tania is still being held in jail in washington. shchevron is laying out its plan to fix the damage from a massive fire in august. it will use chrome alloy to fix damaged pipes. it hopes to get all repairs done early next year and have the refinery back at 100%. after dealing with the devastating effects of superstorm sandy more than a week, people up and down the east coast weathering another brutal storm that is once again hurting travel plans. marla tellez is live with how the storm is affecting flights out of the bay area and you have a look at some of the new damage. >> reporter: yes, i do, laura.

we have some new numbers just coming across the wires. 400,000 homes are in the dark in new jersey. 20,000 of those are new oumgs. there are 60,000 new outages in long island and 55,000 in new york city are without power once again, all because of that ugly nor'easter. she has a name. she is athena. the new storm barreling down on much of the eastern seaboard in the form of heavy rain, strong winds and thick snow. 3 to 6 inches of the white stuff have fallen from connecticut to rhode island. today parts of new england are expected to receive another 3 to 5 inches. 8 inches in higher elevations. keep in mind these are communities filled with people just trying to get a grip on the damage sandy left behind. especially the jersey shore area where governor chris christie is dealing with this new setback. >> i hate setbacks. i don't tolerate them usually very well. but this one i can't control. the weather is what it is.

>> very sad. it's very sad to see us getting pounded again. >> reporter: and the airlines are taking a pounding yet again. dozens of flights at the east coast airports are cancelled and this is affecting flights at sfo where almost a dozen arriving flights from jfk, newark and philadelphia will not land at sfo today. so far delta's 8:15 a.m. flight bound for jfk is cancelled this morning. if you have travel plans, best to check with your airline before you make the trip to the airport. jon and laura. >> thanks for the update. >> man, do people have it bad out there. christina loren is here to check on the troubles out there. the weather keeps pounding them. >> but i do have a little bit of good news. most of the very strong winds and heavy rain right now racing to the north. you can see this nor'easter has really weakened over the past 24 hours so the good news is they actually have a big ridge of high pressure. that same ridge that brought our temperatures toward record levels will start to dry the

northeast out and they'll also get some erm wouwarmer weather. we're watching our own pacific storm. it hasn't rained at this cold levels in quite some time. temperatures will be near freezing as we get through the weekend. that means if you have agricultural interests, you want to keep in mind what the weather will be like. it's going to be very, very cold so we are expecting our first frost of the season. today showers don't arrive until the second half of the day. look at your temperatures, they just tumbled from yesterday's highs. 58 in livermore, 58 in fremont and 60 in red rowood city. we'll help you make weekend plans, after all it's friday eve. let's check your thursday morning drive with our own mike inouye. >> good morning, folks. we're looking over here, our first shot from the peninsula. this is 101 through palo alto northbound at university with these headlights. the volume starting to pick up

good thursday morning to you. for president obama, it's back to work in washington today. officially the only thing on his agenda is the daily briefing but unofficially he has a big problem on his hands. tracie potts is live with more on the nation's looming fiscal cliff. good morning. >> reporter: good morning. we are talking about that because it is getting closer and closer and president obama has already made some phone calls for top democrats and republicans here on capitol hill telling them we've got to get this done this time. there is a new political will here to work together. republican leader john boehner has said that he doesn't want to compromise principles, but they do want to create an environment where compromise is possible, where they can commit to find some common ground. on the senate side harry reid said compromise isn't a dirty

word, although you can't just push us around. the president in his victory speech said we've got to work with both parties to solve the challenges. those challenges included unemployment, the payroll tax cut, the bush tax cuts, big cuts looming for medicare providers, doctors and hospitals, and don't forget automatic spending cuts to the federal government, to their budget. $500 billion of that tol pentagon, which contractors are already bracing for and say could be devastating. so big job. a lot of work to do here w a newly elected president and pretty much the same makeup in congress. >> got to make up for some lost time. thank you very much. we'll check in with you a little later on. some fire stations in contra costa county facing closure after tuesday's election. voters rejecting a parcel tax that would have kept those stations open. christie smith is live in pleasant hill with more on this developing story. >> reporter: good morning to you, jon. more than 50% of the voters

attitude because it's going to get rainy and be a dreary day. west-southwest wind 18 miles per hour sustained in fairfield, 13 in livermore and oakland it's starting to pick up so travel cautiously over the bay bridge this morning. as you know from time to time you can get caught by a very strong gust and that will knock you off course if you're not holding on to your steering wheel very tightly. the leading edge starting to push into eureka. as we continue through the morning hours, the system will sag to the south. so for us what that means is showers starting at about 11:00 to noon in the north bay spreading south throughout the day today. if you're heading to tahoe, a lot of people do have plans to hit the sierra. keep in mind it's going to be very active leer. snow levels will fall to 2500 feet and we could see 4 to 10 inches, even a foot of snow above 7,000 feet. that bodes very well for the skiing season. in addition to that rain and the snow coming down, we're talking about gusty winds, so dangerous

conditions. you want to really take it easy. we stop the clock on your futurecast at 11:00 a.m. starting to get your first showers up in the north bay. showers spread south into san francisco and oakland, starting to see slick conditions there. then between 2:00 and 3:00, we get the action in the south basement we'll get a little bit of a break for the first part of your friday and the showers roll right back in, clearing out the first part of saturday. 58 in livermore, right around 50 degrees in some of your cities that do not make it out of the fog and low clouds, so temperatures are going to be very cold in half moon bay and pacifica today. as we head through saturday, sunday, starting to clear you out. let's check your drive. good morning, mike. >> good morning. good morning, folks. b.a.r.t. still reporting a 15-minute delay because of some equipment problems coming out of the south san francisco station. so if you're heading up the richmond area or heading south

some 3,000 inmates in jail under the three-strike law in california could soon be resentenced or released altogether. proposition 36 passed in tuesday's general election. the measure is designed to make sure life sentences are reserved for people who have committed three serious or violent felonies. we talked to one co-author of the new law and to a man who fought against it. >> we were sending people away for life for stealing a loaf of bread, petty theft, simple drug possession. >> if they can see the train coming down the tracks, yet the guy only stole a loaf of bread or he managed to get the purse away from the girl without putting a bullet in her head, then they're not going to be able to charge for three strikes. >> the amendment could save up to $100 million a year once that law takes effect. it is 5:48 right now. the nhl and players association heading back to the bargaining table today.
